On August 21, 2024, the Delhi High Court injuncted Haute 24 from using the copyrighted photographs, images and promotional material of Louis Vuitton products on its website.
Haute 24, according to its website, is a Californian entity with Indian stores, bringing “the most exclusive fashion products to people’s homes in India”. The website seems to offer all brands of luxury goods including “preloved luxury”, a term for goods that have been previously owned and used, but not new.
Louis Vuitton sued Haute 24 for copyright infringement of the photographs of its products, claiming that it was used by Haute 24 without authorisation on its website for selling products which Louis Vuitton considered non-genuine. During the hearing, Haute 24 stated before the Court that while they have been in the business of selling genuine Louis Vuitton products, both new and certified pre-owned, they discontinued selling Louis Vuitton products post the suit. The Court was informed that the infringing photographs were also taken down by Haute 24. Louis Vuitton, however, pressed the Court that costs be awarded to them.
The Court not only injuncted Haute 24 from using on its website the photographs, images and promotional material, in which, copyright vests with Louis Vuitton, but also injuncted Haute 24 from dealing in the new products of Louis Vuitton. While the Court permitted Haute 24 to continue their business of pre-owned Louis Vuitton goods, they were directed to conspicuously display on their website that the goods sold by them are certified pre-owned goods of Louis Vuitton. Additionally, the Court imposed costs of INR 500,000 (~USD 5950) on Haute 24 to be paid directly to Louis Vuitton in France.
