
In Largan Precision Co., Ltd v. Honor Device Co., Ltd & Anr., the Delhi High Court granted an ex-parte ad interim injunction in favour of the plaintiff, Largan Precision Co., Ltd (Largan), a Taiwanese company against Honor Device Co., Ltd (Honor), a Chinese company, and its Indian subsidiary.

Largan had filed an infringement suit against Honor and its subsidiary alleging infringement of its patented camera lens technologies (Patent numbers IN 395754, IN 395095, and IN 363203) used in Honor’s 200 series products.
Largan argued before the Court that despite reaching out to Honor in June 2023 to stop the unauthorized use of its patented technology and offering a license, Honor did not respond. Instead, Honor continued the infringing activities through the newly incorporated Indian entity.
Largan submitted that despite a prior business relationship with Honor, it had not licensed or supplied the infringing lens assemblies of the Honor 200 series. Hence, it constituted an unauthorized use.
Largan also argued that Honor’s financial standing in India is uncertain and likely insufficient to satisfy any award of damages, should the Suit be decreed in Largan’s favour.
After reviewing the claim mapping charts, teardown reports, and financial submissions, the Court found that Largan had established a prima facie case of infringement. The Court held that continued sale of the Honor 200 devices would cause irreparable harm to Largan by eroding its exclusive rights, goodwill, and revenue. Further, the Court reasoned that the balance of convenience lay in favour of the plaintiff, as monetary relief would be illusory given the defendants’ precarious finances. On this legal rationale, the Court granted an ex-parte ad-interim injunction restraining Honor from manufacturing, importing, selling, or distributing the Honor 200 series smartphones in India until the next hearing in November 2025.
